MUMBAI: A Delhi man has been prescribed Viagra-like erectile dysfunction medication for his sex life after a complaint was filed by the Delhi High Court.
Rajiv Shah, 52, is facing a number of similar allegations in the case related to the allegedly improper purchase of the drugs from a pharmacy in a Mumbai suburb.
He had been charged in the suit with possession of the drugs after he was allegedly seen buying them in the same manner at a shop near him. The complaint said he had been taking the drugs for four or five years.
“The allegations in the suit are a matter of policy and practice and are not substantiated. The complaint alleges that the pharmacists were under pressure to fill the prescriptions, and they had failed to provide adequate notice to the government,” the judge said.
The complaint was filed by Shah in the court and it was alleged that he had purchased the drugs from the pharmacies without his knowledge.
The suit claimed that the pharmacy was selling the drugs “off-label” in the city and had not adequately disclose the drugs’ composition or duration to the government.
The court said the allegations were too serious, and further, they would have been too broad in view of the fact that the drugs were not manufactured by the pharma companies.
“This case is for a remedy to be obtained by the government in a complaint where the accused has claimed wrongdoings have been done and in view of the above facts, we are satisfied that the accused has been seeking to establish a recovery under the provisions of the Health and Safety Act, №1.01,” the judge added.
The judge said the matter would be submitted to a special court in Delhi, where the case would be tried.
“The matter of the violation of the Health and Safety Act is being brought in the court. It will be submitted to the special court. The matter will be tried on the evidence and will be complete in duration,” the judge said.
The court said the government had alleged that the drugs had been bought from the pharmacies, but it was claimed that the drugs were being sold to a middleman, who had no control over their use and storage.“The government had alleged that the pharmacy had been involved in the purchase of the drugs, and had not provided adequate notice to the government. This was alleged to be the basis for the alleged improper purchase of the drugs from the pharmacies,” the judge said.
The complaint said Shah had taken the drugs for four or five years and had been using them “until his health and safety had been confirmed”.
The court said the cases had been brought in the court on allegations of illegal possession of the drugs, as well as making of false statements and fraudulent concealment.
“The Court had ordered that a special court in Delhi issue the matter of the violation of the Health and Safety Act, №1.01, to the special court. The case will be submitted to the special court in Delhi, where the case will be tried,” the judge said.
According to the government, the drugs were not manufactured in the city and had not been sold to the public.
